2. Definitions

• Consumer: a natural person acting for purposes outside their trade or profession.
• Service: the Addressly web-based software that scans the internet for real estate listings and sends emails on behalf of users.
• Subscription: a monthly paid plan granting access to the Service.
• User: the consumer who creates an account and uses the Service.

3. Applicability

These Terms apply exclusively to consumers (B2C). Business or professional use is not permitted unless explicitly agreed otherwise in writing.

4. Description of the Service

Addressly scans publicly available online sources for new real estate listings and sends emails to real estate agents from the user's own email account, based on the user's input and configuration.

The Service is provided digitally and online only. We do not guarantee that listings will be found, emails will receive responses, or specific outcomes will be achieved.

5. Account & Access

• An account is required to use the Service.
• One account may only be used by one natural person.
• Users are responsible for keeping their login credentials secure.
• Users must provide accurate and complete information.

6. OAuth Email Access & Consent

To provide the Service, users must connect their email account via OAuth.

By connecting an email account, the user explicitly agrees that:

• Addressly may send emails on the user's behalf;
• Addressly does not read inboxes or stored emails;
• all emails are sent using content, settings, and criteria defined by the user.

The user remains fully responsible for all emails sent through the Service, including their content, recipients, and compliance with applicable laws.

7. User Data

• Users may input personal and housing-related information.
• Users confirm they have the right to provide this data.
• Personal data is processed in accordance with applicable GDPR legislation and the Privacy Policy.

8. Subscription, Pricing & Payment

• The Service is offered as a monthly subscription.
• Price: €39 per month, including VAT.
• Subscriptions renew automatically each month.
• Payments are processed via Mollie.
• Payment is charged monthly after the first transaction.

9. Failed Payments & Suspension

• A 4-day grace period applies after a failed payment.
• If payment is not received within this period, access to the Service is automatically suspended.
• Access is restored once payment is successfully completed.

10. Right of Withdrawal (Consumers)

Consumers normally have a 14-day right of withdrawal.

Because Addressly provides a digital service with immediate performance, the right of withdrawal expires immediately when the first email is sent on the user's behalf.

By purchasing a subscription, the user:

• expressly requests immediate access to the Service;
• explicitly acknowledges that the right of withdrawal is lost once the first email is sent.

11. Refund Policy

• A refund is possible only if no email has been sent on the user's behalf.
• Connecting an email account via OAuth alone does not remove refund eligibility.
• Once the first email has been sent, no refunds are granted.

12. Cancellation

• Users may cancel their subscription at any time via the dashboard.
• Cancellation stops future renewals.
• Access remains available until the end of the current billing period.
• No partial refunds are provided for unused time.

13. Availability & Changes

• The Service is provided without any uptime guarantee.
• Maintenance or temporary interruptions may occur.
• Addressly may modify features, functionality, or pricing.
• Changes affecting existing users will be communicated at least one month in advance.
• Continued use after the notice period constitutes acceptance.

14. Termination

Addressly may terminate or suspend accounts:

• for abuse, misuse, or illegal activity;
• for violation of these Terms;
• without reason, with 30 days' prior notice.

Immediate termination may occur if required to prevent harm or legal violations.

15. Intellectual Property

• All intellectual property rights related to the Service remain with Addressly.
• Users receive a limited, non-exclusive, non-transferable license to use the Service for personal purposes only.
• Reverse engineering, resale, or unauthorized copying is prohibited.

16. Liability

• Total liability is limited to the fees paid during the current billing period (€39).
• Addressly is not liable for indirect or consequential damages.
• Nothing excludes liability for intent (opzet) or gross negligence (grove nalatigheid) where exclusion is not permitted by law.

17. Privacy

Personal data is processed in accordance with applicable data protection laws and the Privacy Policy.

18. Changes to These Terms

• Addressly may update these Terms from time to time.
• Material changes will be communicated in advance.
• Continued use of the Service constitutes acceptance of the updated Terms.

19. Governing Law & Jurisdiction

These Terms are governed by the laws of the Netherlands.

Disputes shall be submitted to the competent Dutch court, without prejudice to mandatory consumer protections under EU law.

20. Severability

If any provision of these Terms is found invalid, the remaining provisions remain fully effective.
